What You Will Learn

PHASE 1: Discovery
When the client is getting ready to hire and immediately afterward, it’s essential to get started on the right foot and keep the client on track. The Discovery phase is all about the client onboarding process, and creating a positive client experience during a very stressful time in their lives. In this phase, you will learn the essential documents, tools, checklists and client prompts that move the information-gathering process powerfully forward.
- Essential fee agreement provisions to keep the client on track
- Using the Authorization For Release to help with document collection
- How to counsel the client on the Medicaid Document Checklist so that they get you the documents you actually need (not their interpretation of what you need) for success
- How to counsel the client on due dates so that they don’t waste valuable time

PHASE 2: Analysis
After the client hires, you must keep the case moving forward as quickly as possible to avoid the client losing more funds than necessary. The Analysis phase is about the meticulous process of completing the information-gathering AND starting the working documents, including the Client Working Spreadsheet and the Analysis Task List.
- Starting the Client Working Spreadsheet to keep track of client data, due dates
- Creating and using the Analysis Task List to move along document gathering and keep client accountable

PHASE 3: Strategy
The Strategy phase is where you take the information and put it into a usable format for the attorney to develop the perfect game plan that will ensure success.

- Setting your attorney up for success in developing the client strategy
- Setting expectations about “who does what” to get the strategy implemented in a timely manner - attorney, client and staff
- Developing the Client Strategy Instructions - with examples

PHASE 4: Implementation
Implementation is about getting the application DONE, both accurately and timely...but also in a way that makes it as easy on the caseworker as possible...which is to YOUR and YOUR CLIENT’S benefit.
- How to easily create the Summary of Case Template using the Working Spreadsheet and Exhibits
- How utilize the Summary of Case Templates in a way that makes filling out the application a breeze - AND makes it easy for the caseworker to say YES to your client’s application!
- How to compile and structure the exhibits required to support a successful application

PHASE 5: Post-Submission
Even after you’ve submitted every single thing the caseworker needs, the case is far from over. In fact, there are still things you need to do to make sure that the resolution of the application is both timely and successful. This phase is about all the details that get ahead of any post-submission problems - before they start, and stopping the caseworker from issuing a denial.
- How to communicate with the caseworker to ensure that the application approval will go smoothly and to get ahead of any potential problems - BEFORE they occur
- Communicating with the skilled nursing facility about the application, expected penalties and payments
- Anticipating and preparing for a post-submission additional request for documents
- Staying on top of the decision deadline

PHASE 6: Determination
Once you’ve received a decision, you need to make sure that it is correct. Even approvals, when given improperly, can blow up your planning. It’s also about maximizing future revenue potential!
- Ensuring penalties have been properly applied
- Communicating with the skilled nursing facility about approvals and post-approval payments due
- Reviewing the file for any immediate, last minute legal services add-ons
- Looking for opportunities for future asset protection and probate avoidance
- What to do if you get an incorrect denial or incorrect approval
